TERMS & CONDITIONS  HAWAI’I VOLCANOES NP

Please Read Carefully the TERMS and CONDITIONS below, before applying…

COVID-19 SAFETY: Face masks may be required on NPS-administered lands where physical distancing cannot be maintained and in all NPS buildings and facilities. Park operations vary based on local public health conditions. Before a residency, please check the park website to determine its operating status. Additional details are available at www.nps.gov/coronavirus. It is the artists’ responsibility to understand and abide by the current COVID19 policies of both the Federal Government and the State of Hawai’i that may be in force at the time of residency.

LODGING AND PRESENTATION VENUE: The artist in residence will be granted lodging and a venue (with NPS/NPAF agreement this venue may be online post-residency) for at least one Public Event / Presentation of a workshop, lecture, or concert. Please indicate in your application if you would like to give more public presentation(s). The artist must commit to the entire month term that they will be applying for. 

INSURANCE: All insurance including automobile, health, accidental, and insurance to cover all art, supplies, personal items is the sole responsibility of the artist as any and all insurance will not be provided by NPAF or the NPS or concessionaires. Proof of insurances must be provided. Any and all terms herein may change and are subject to the approval of the NPS and NPAF. All insurance is required of the selected artist(s) including automobile, health, accidental and insurance to cover all art, supplies, personal items and is the sole responsibility of the artist as any and all insurance will not be provided by NPAF or the NPS or NPS concessionaires or park Friends groups. Proof of insurances must be provided. 

REFUND POLICY: The application fee is non-refundable. Even in the case of changes in programming due to NPS needs and other affiliate agencies.

VISAS: Any Visas required by the US or any other government will be the responsibility of the participant. If the program is canceled, not accepted, or changed in any way, at any time, no refunds or any fees, including application, will be issued.


FOR THE ARTISTS: An ‘Artist Couple’  or ‘Artist Group’ is defined as a creative partnership—not necessarily spousal or legal—between two or more people for the purpose of making artwork at the park. Artists may not consider any additional unlisted party a part of the AiR program unless they were included as an “artist couple” or “artist group” in the artist’s original application and proposal. Residency, housing, and other park amenities are exclusively for the artist’s use only. For the purposes of this Hawai'i Volcanoes National Park NPAF Artist in Residence Permitting Process, every person attending the residency is considered an applicant.

ART GUIDELINES: It is National Parks Arts Foundation’s hope that works produced during this time will characterize Hawai'i Volcanoes National Park for present and future generations and offer park visitors and the general public the opportunity to see the park's heritage through the creative vision of artists.

PUBLIC INTERACTIONS: Artists must address, in their proposal, how they plan to engage visitors, in Plein air and/or during art process time and in their public engagement. Any ideas for public interaction will be considered but must be authorized explicitly by NPS and NPAF. This can include public programs, special engagements, en Plein Air locations, and social media for visitor engagement purposes.

RELATIONS WITH NATIONAL PARK SERVICE (NPS): The Artist should expect and be welcoming to NPS, concessionaire staff, visitors, and the public inquiring about them and the Artist in Residence program on occasion and while they are at large in the park. Due to Covid and volcanic eruptions, the NPS is very busy for the 2021-2022 season. With all due respect, the NPS will contact NPAF to meet with the artists prior to/if any meetings or special excursions will be granted. Please wait to hear from NPAF before official introductions. The artist should expect and be welcoming to NPS, concessionaire staff, visitors, and the public inquiring about them and the Artist in Residence program on occasion and while they are ‘at-large’ in the park.

ARRIVAL: For ease of coordination and communication with the Park Service, Artists or Artist couples must schedule their arrival between 10-3 on federal workdays, and must have their own transportation for the month of the residency.


PARK RULES: Artists will abide by all park rules, NPS rules, and regulations concerning all aspects of the park and its environment. In addition, the Artist is expected to be courteous to all public, visitors, and NPS staff during their stay. USE OF PARK RESOURCES AND ORIENTATION: The parks in Hawai’i are historically religious and cultural treasures, and as such are subject to extra care and consideration. As an introduction and fuller appreciation of park resources, each AiR participant may be able to take advantage of the Hawaii Volcanoes National Park archives or museum (if available), and the natural and cultural collections as part of the park’s Museum Program. Further, each participant may be able to discuss with park staff the diversity of park resources, themes, and historic culture of the park. This process may be inclusive of advice and recommendations of cultural advisors and/or Kupuna (Hawai’ian Elders or Spiritual Leaders). This process is necessary in order to educate and maintain the integrity of the park, the AiR program and to honor the cultural heritage of Hawai’i and its’ sacred volcanoes. 

The Artist acknowledges that if their work includes a scientific or cultural component that involves advice or information from Park Staff or any of the scientific research programs around the volcanoes, it is their responsibility to contract/permit separately for such. There are many people that work around the volcanoes in many capacities and they may be willing to talk informally as advisors. However, Park staff are not generally available to the resident and should be treated courteously and with consideration to their time and expertise.

RESPONSIBILITIES: Artists need to provide their own art supplies, equipment, personal items, all insurance, and reliable transportation. Artists should be self-sufficient, independent and enjoy working in a public environment, and able to commit to the full AiR term. If applicable, the AiR artist must remain accommodating to inquiring park visitors with regards to the thoroughfare location of their workspace. The artist(s) will comply with all park regulations and policies governing park employees, volunteers and visitors.

Special Requirements: 


PRESENTATIONS: Artists may present, at minimum one, one-hour public program, workshop, concert, or lecture during their residency at Hawai’i Volcanoes National Park, which can be presented either at the park or another venue as deemed by NPAF and NPS staff. With NPS/NPAF agreement this venue may be online post-residency. This presentation (above) may be the same program repeated and will reflect the artist’s medium, interest, and park experience. Workshops are open to both visitors and the public at large. Artists must provide their own car and liability insurance, supplies, and equipment for these presentations. 

ADDITIONAL PRESENTATIONS: We also encourage artists to give public presentations in their own community about their residency experience in Hawai’i Volcanoes National Park to further broaden the reach of the program’s purpose.

INTERNATIONAL ARTISTS: We have hosted a number of international artists successfully in the past. We encourage you to apply. However, depending on the visa that is required of you for your stay by the relevant federal agency, NPAF may not be allowed under U.S. law to convey donated, travel, or other funds to you for the residency. We may be able to reimburse you up to the total amount (if any) stated in the park application. All stipends and/or reimbursements are governed by the US and your country of origin, NPAF, and NPS abide by these laws. So if this is crucial, please check with the U.S. embassy/consulate in your country.

INTERRUPTIONS, CANCELATIONS, AND RESCHEDULING: NPAF cannot guarantee or be held responsible for AIR interruptions or cancellations because of Government decisions or natural causes, or absolutely anything. The artist in residence program may be canceled or interrupted due to a government shutdown, for unforeseen circumstances, or during any hazardous weather conditions including, but not limited to, high SO2 (Sulphur Dioxide) levels, fire danger, etc. No funds, grants, or stipends will be issued if the program is canceled or interrupted for any reason.

The artist(s)-in-residence program may be canceled or interrupted due to a government shutdown, artist non participation, or during any hazardous weather conditions, including, but not limited to, fire danger, environmental concerns, or any unforeseen circumstances, natural or otherwise, to which NPAF and any affiliates will NOT be held accountable or responsible, no refunds will be issued. NPAF cannot guarantee or be held responsible for AIR interruptions, nonacceptance of AIR program, artists, artwork, or cancellations or delays because of Government decisions or natural causes. NPAF will try to make all efforts to reschedule a delayed residency, but cancelations do occur.

 

HEALTH WARNING: The island of Hawai’i is subject to high concentrations of volcanic fumes, especially sulfur dioxide gases. The fumes are known to be hazardous to an unborn fetus, and persons with heart and respiratory problems. 

The Hawai’ian coast experiences VOG (fumes from the volcanic activity) conditions throughout the year. Long-term effects on normal healthy persons are unknown. When the AIR program is terminated or interrupted, the artist in residence will be directed to relocate from the hazardous area. The remainder of the residency term may be negotiated to be made up at a later date. 

ARTIST SELECTION POLICY: Only selected artists will be contacted. It is the artists' own initiative to check the status of their proposal submission through accessing their proposal submission through the URL for which they applied. At request, through the URL, we will allow edits and additions up to ten days before the deadline. If you are contacted as a finalist & if our panelists feel that further detail is needed for the application — finalists will be asked to submit the required materials (such as a detailed proposal, etc).

REGARDING CONTRIBUTIONS: NPAF is NOT responsible for and will not return any application donation fees, contributions, monies spent, monies owed, or any funding if there is a natural occurrence or anything that interrupts, changes, delays, or cancels the program in any way. Fees are donations/contributions and on par with comparable fees, to contribute a higher or unpublished amount as a donation, contact NPAF. 

ARTIST’S COMMITMENTS: If the chosen artist cancels, delays, or in any way impedes the program after committing to the program, they will be held responsible for all funding and expenses devoted to any part of the program. The accepted artist will owe any funds spent or owed by/to NPS or NPAF as it pertains to the program if they (the artist(s)) cancels, delays, or changes any part of the program. If the AiR program is terminated or interrupted, the artist(s) in residence may be directed to relocate from the park or hazardous area. The remainder residency term may be made up at a later date at the discretion of the NPS and NPAF.

Artist(s) will be responsible for all costs affiliated with the program if they are the selected artists(s) to the program, and then cancel, change or delay the program in any way, prior, during, or post the residency term. 

USE OF ARTWORK AND LIKENESSES: Applicants grant use of any and all pieces of their submitted application proposal materials, emailed or any other electronically send images/items, to further any purpose of NPAF, any NPAF affiliate, and/or the program (and/or promoting the selected artist(s)) through television, radio, interviews, magazines, books, internet, newspapers, grants or endowment applications, presentations and any and all media.


POLICIES & TERMS MAY CHANGE: Any terms herein may change without notice and are subject to the approval of the NPS and/or NPAF, or any governing entity. All AiR participants may be required to accept further conditions and contracts including but not limited to; Background checks, codes of conduct, Gift and/or donation agreements, images releases for their person and/or artwork, codes of conduct, special use permits, rules and regulations, housing agreements, volunteer in the parks contracts, J-1 visa application and acceptance (for international artists) and any other apparent and unforeseen agreements required of any governing entity, namely the NPS, NPAF and/or NPS concessionaires, and all pertaining laws. All funding and acceptance to programs are subject to U.S. and international laws.
